Oakville, by the tree rules

Big trees, old lots and new ones, and a tree bylaw that tightened in 2024. We scope every Oakville job around it before we draw a line.

Oakville's housing runs from the custom builds of Old Oakville, on broad streets with no sidewalks, to Glen Abbey and River Oaks from the 1980s and 1990s, Clearview from the 1980s, Joshua Creek from after 2000 with young trees, and Palermo at about ten years old. Morrison lots are more generous than in the newer areas. The older the neighbourhood, the bigger the trees and the more of the job is about working around them.

We treat Oakville subgrade the way we treat Mississauga's: as frost-susceptible clay until the excavation shows otherwise. Every patio gets geotextile, compacted Granular A and HPB bedding. Every grade falls away from the house. And on the bigger, older lots, much of the drainage work is about roots and shade, because lawns under mature canopy stay wet and thin.

The jobs that come up most: replacement planting where ash came out, since the Town reports most of its 43,000 woodland ash are dead; natural stone and planting on Old Oakville front yards; full backyards in Glen Abbey, Bronte and River Oaks; and first patios and trees in Joshua Creek and Palermo.

Oakville's tree bylaw shapes all of it. Since March 2024, cedar no longer counts as a replacement tree and cash-in-lieu is limited where replanting is possible. That changes what we plant, so we check it before the planting plan, not after.

The neighbourhoods, as a local sees them.

  • Old OakvilleCustom builds on broad streets with no sidewalks, mature trees, front gardens that face the street. Natural stone and careful planting.
  • Glen Abbey1980s and 1990s houses, some with yards that lost their shade when the ash came out. Replacement trees, beds and rebuilt patios.
  • BronteThe west end near the lake. Sloped and older yards that suit stepped walls and full design-builds.
  • MorrisonLots more generous than in newer areas, often with mature canopy. Terraces, walks and planting around protected trees.
  • Joshua CreekBuilt after 2000 with young trees. First patios, sod and planting that will grow with the yard.

The rules on your lot.

Trees
Private Tree Protection By-law 2017-38. A permit and an on-site assessment are needed before removing a tree 15 cm or larger at chest height. Since 25 March 2024, cedar is off the replacement list and cash-in-lieu is limited where replanting is possible. Woodlands over 0.5 ha fall under Halton Region Tree By-law 121-05. Check the permit fee with the Town.
Decks, sheds and fences
Sheds, cabanas and gazebos need a permit over 15 m2 or with plumbing. Decks need one if over 10 m2 and higher than 61 cm, and any deck attached to a house needs a building permit. Fences under By-law 2002-034 may be 2.0 m at the rear and side, or 2.2 m if the part above 1.9 m is lattice, and 1.5 m at the front with anything over 1.0 m in lattice. Privacy screens may reach 2.9 m with a setback.
Pools
A pool needs an enclosure permit before construction begins.
Watering
Halton Region's Waterworks By-law 79-19 uses odd and even calendar days by house number. Level 1 is voluntary, and new sod may be watered until it is established.

Straight answers

Can I plant cedars as replacement trees in Oakville?

Not since March 2024. The Town removed cedar from the replacement list. We plan replacement trees from the current list before we draw the planting.

How much is an Oakville tree permit?

The fee was not published on the Town pages we checked, so we confirm it with the Town for your address. An on-site assessment is part of the process.

Does my attached deck need a permit?

Yes. In Oakville, any size deck attached to a house needs a building permit. We do not build decks, but we design patios and planting around them.

When can I water new sod?

Under Halton's rules, new sod may be watered until it is established. After that, follow the odd and even days by house number.
